1. Acceptance of Terms

By accessing or using myGardenHQ, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Account Terms

When creating and using a myGardenHQ account, you agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account password
  • Promptly notify us of any unauthorized use of your account
  • Not share your account credentials with others
  • Use the service only for lawful, personal purposes

3. Subscriptions & Cancellation

myGardenHQ offers a free tier (Free) and a paid subscription plan (Pro). Pro is available at $4.99/month or $24/year.

  • Paid subscriptions are billed on your billing date — monthly or annually, depending on your plan
  • You may cancel your subscription at any time by contacting us at hello@mygardenhq.com
  • Cancellation takes effect at the end of the current billing period — you retain access until then
  • We do not offer prorated refunds for partial months, except at our sole discretion

4. Your Content

You retain full ownership of any garden data, notes, harvest logs, or other content you submit to myGardenHQ. By using the service, you grant us a limited, non-exclusive license to store and display your content solely to provide the service to you. We will never claim ownership of your data or use it for commercial purposes beyond what is described in our Privacy Policy.

5. No Warranty

myGardenHQ is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or that planting recommendations will result in successful harvests. Use of growing advice is at your own discretion.

6. Limitation of Liability

To the maximum extent permitted by law, myGardenHQ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits, data loss, or crop failures.

7. Termination

We reserve the right to suspend or terminate accounts that violate these terms or are used in ways harmful to other users or the service. You may delete your garden data at any time from the Settings page. Upon deletion, your garden data will be permanently removed. Your authentication account (email) is managed separately; contact us to request its removal.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Maryland.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of myGardenHQ after changes constitutes your acceptance of the updated terms.
